The woman who was filmed after refusing to swap her plane seat with a crying toddler has spoken out to give her version of events, including her plans to sue the ‘rude’ passenger who recorded her.
Jeniffer Castro certainly isn’t the first person to refuse to give up their plane seat for a child, and she probably won’t be the last either.
However, the 29-year-old from Brazil has revealed plans to sue the child’s mother after she whipped out her phone and started filming her before sharing the clip online where it later went viral.
The incident
On December 4, 2024, Castro got on a domestic flight in Brazil with GOL Airlines and found a toddler in her seat.
The child’s mother explained they wanted to look out the window, however, Castro explained she’d booked the window seat and it was subsequently assigned to her, which resulted in her asking them to move.
The mom then brought out her phone and started filming Castro, heard in the footage saying: “I’m recording your face, this is disgusting. It’s the 21st century and people have no empathy for children.”
However, Castro has since spoken out about her version of the incident and even revealed whether she plans to take legal action against the mom.

‘Measures being taken’
During an appearance on Cola Mais Podcast – the episode being shared on January 22 – Castro was asked whether she’s considered taking legal action against the plane company or mother.
While not stating what ‘measures’ and whether they’re legal or not, she said: “[Translation] Measures are now being taken. What I went through wasn’t easy. The flight attendants could have asked me if I need anything, or if I was bothered by the passenger, but they didn’t. They stayed out of it.”

Castro said when she got on the plane she told the mom and child it was her ‘seat’ and ‘waited for him to leave’.
“A guy across the aisle said ‘Change with him, you sit next to the aisle and he’ll have your place’,” she continued.
After getting to her seat, Castro says the mother was ‘very rude’ to her and ‘the boy cried the entire flight, it was around 50 minutes from Rio de Janeiro to Belo Horizonte’.

The mom recorded Castro and the footage went viral online, receiving mixed responses, although many sided in Castro’s favor.
“She is well within her right not to move! I’m sick of self-entitled parents,” one Facebook user said, as another wrote: “I would sue everyone who filmed me against my will. Just saying.
As a photographer… I need permission for everyone I have a picture of or they can sue me for this. You need permission of everyone that you have pictures of and videos of… I think people have forgotten this fact in this age of social media.”
“She paid for it, it’s her seat. The toddlers parent’s poor planning doesn’t constitute an emergency for the lady so nope,” a third argued.

A plus-sized passenger has left people divided after refusing to give up her extra seat.
Knowing she was overweight and that most commercial airlines don’t accommodate for this, the 34-year-old bought two seats.
She’d previously felt uncomfortable being squashed into one seat, so thought this was a good solution to her problem.
But she was met with criticism during her flight for not giving up her spare seat for a toddler.
Taking to Reddit, the anonymous poster said that her travels were going fine before a mom on her flight ordered her to ‘squeeze into one seat’ so that her young son could sit in the other.
But the passenger declined and explained that she had paid for the extra seat for more space.
“She makes a big fuss over it, which got the flight attendant’s attention. She told the flight attendant I was stealing the seat from her son, then I showed my boarding passes, proving that I in fact paid for the extra seat,” she penned.

“The flight attendant asked me if I could try to squeeze in, but I said no, that I wanted the extra seat I paid for. The boy, who the mom said is 18 months old was supposed to sit in her lap so he could do just that. The flight attendant eventually told the mom to put her son in her lap.”
She went on to say that she received ‘dirty looks and passive-aggressive remarks’ from the mom for the rest of the flight.
Admitting she did feel a bit bad as the toddler seemed ‘hard to control’, she asked fellow Redditors if she was the a*shole in the situation, and a large majority of people were on her side.

“She’s [the a*shole] for not buying a seat for her son and assuming someone else would give up a seat they paid for,” one person replied.
Another person who was on her side applauded the woman for buying an extra seat.
“I hope it doesn’t sound condescending to say, but good for you buying the extra seat,” they wrote. “You being the sort of conscientious person who will spend the extra money to avoid encroaching on others is probably why you are having (needless) self-doubt about the encounter.”
A different person argued: “You paid for the seat, you get the seat. If she wanted a seat for her son, she should’ve paid for it.”
While the vast majority of Reddit users supported the woman, one wrote: “Flights overbook all the time, especially during the holidays – how can you justify having two seats to yourself?”

As we approach the summer months and many start to head on their vacations, the topic of travel etiquette comes more into the limelight.
There is no right and wrong when it comes to doing this whole travel malarky, though many on social media have thoughts on what’s right and wrong.
Now, there’s been a lot of back and forth about if planes should be more accommodating to plus-size passengers, including allowing them free seats if required, along with having bigger bathrooms.
One 34-year-old plus-size passenger ended up shelling out for an extra seat in order to be more comfortable on her flight – but still ended up getting grief from other passengers.
The woman said she has previously experienced discomfort when attempting to fit into a single seat onboard due to her weight.
However, the woman’s plan to have a nice and relaxing flight on the two seats was quickly dashed when a young mother requested that she ‘squeeze into one seat’ so her young son could occupy the other seat.

On the ‘AmItheA**hole’ Reddit forum, the woman penned: “I am obese. I’m actively working toward losing weight, and I’ve made progress – but I booked an extra seat because I’m fat.”
She added: “[The mother] made a big fuss over it, and she told the flight attendant I was stealing the seat from her son.
“Then I showed her my boarding passes, proving that I paid for the extra seat. The flight attendant asked me if I could try to squeeze in, but I said no, that I wanted the extra seat I paid for.”
The passenger argued that the toddler – who was just 18 months old – would not require a seat for the flight and that he could sit on his mother’s lap.

She continued: “The flight attendant eventually told the mom to put her son in her lap. I got dirty looks and passive-aggressive remarks from her for the entire flight.”

A plane passenger and TikTok user has sparked debate online after sharing her decision not to give up her seat to a mom traveling with her son.
As soon as you hear of this situation, it’s easy to picture the scene: a woman sitting comfortably in her chair, settling in ready for the flight when she’s approached by a stressed-out looking mom with a toddler in tow.
For whatever reason, the mom and toddler aren’t sitting together, so the mom asks the woman to swap seats.
Though she probably could have taken better steps earlier to ensure she and her son were sitting together, it’s not a totally unreasonable request, right?

Well, what about if the son actually wasn’t a toddler at all?
In her TikTok video, passenger Surya Garg asked viewers for their opinions as she explained that she’d typically be okay with giving up her seat if approached by a family with young kids.
“I remember people giving up their seats for me and my brother when I was younger so we could be next to our parents, I get it,” she said.
However, Surya then continued: “Tonight, I not only got asked to give up my window seat, so that I could sit in a middle seat, but the quote-unquote family that asked me to do this was a mother and her son – her son had to be a minimum of like 16 or 17 years old.
“This mans was 6’4″, talking on the phone to his girlfriend the entire time we were boarding.”

Since Surya was already seated, she decided to politely decline the mom’s request and explain to her that she’d paid extra for the seat.
This apparently didn’t go down well with the mom, as Surya continued: “This woman makes the nastiest face at me I’ve ever experienced, sits down next to me in the middle seat [and] her son goes back to the middle seat he was assigned to.”
The TikToker then claimed that the mom spent the whole flight ‘muttering profanities’ at her.
“Was I in the wrong here?” Surya asked.
Many viewers quickly weighed in to share their thoughts and there were a lot of people on Surya’s side, with one viewer writing: “You are not wrong! And I’m a mom but of littles. We always plan and pay the extra to sit together however…”
“People should just buy their seats! Not giving up my window — that I paid for — for a middle seat!,” another added.
However, other viewers stuck up for the mom in the situation, with one saying they would give up their seat ‘100% of the time’.
“As a parent we only have a solid 18 years before they go out on there [sic] own […],” they added.
Another pointed out there may have been other factors to account for, saying: “l understand, sometimes though people have non-visible disabilities like my adult son, so in that case that would have been really helpful.”
Surya’s video has so far amassed more than 1.5 million views.

A man has been praised on social media for refusing to swap seats with someone.
There’s always someone somewhere complaining about another person not swapping seats on a plane with them.
Earlier this month, one woman sparked an online debate after explaining that she refused to move seats so that a seven-year-old kid could look out of the window.
The woman in question has lupus and said that she often books a window seat so that she can lean on the side of the plane and sleep, as her condition makes her tired.

But shortly into the flight, a dad asked if she would swap seats with his son as it was his first flight and the youngster wanted to look at the views.
As a compromise, she offered to leave the blind open so that the boy could look out and she’d used her eye mask to block out the light.
The child and father continued to complain about the situation, but she refused to move – and her decision to do so left people divided on Reddit.
And now, another Redditor has taken to the social media platform to share their own experience where a mother tried to get him to give up his economy plus seat that he’d paid extra for.

According to the Redditor, the mother wanted her nine-year-old son to sit with her, but rather than her going to where her son was (who was not in economy plus), she wanted him to come to sit with her.
The guy went on to recall: “I ask how much cash she has to repay me for the money I spent on the seat, she says I’m cruel for leaving her son with anxiety sitting alone.
“I ask if she offered the person sitting next to her son her seat in economy plus, she said she ‘needed the leg room’.”
The man then proceeded to call out the mother for prioritizing her comfort over her son’s wellbeing and ultimately made her cry.
Eventually the guy who was sat next to her son comes and sits next to him.
He then asked if he is the a**hole, however, many people decreed that he wasn’t, as one person replied: “Everyone knows that if you’re looking to swap seats, you always offer the better seat to the person you’re inconveniencing.”
“This is probably something she has done before,” suggested someone else.
While a different person went as far as saying the guy was ‘doing the lord’s work’.
“Don’t feel bad about her tears. They weren’t real anyway,” someone else added.
